Immigrants Claim Lawyers Defrauded Them and They May Be Deported

Fraudulent Immigration Services Prompt Lawsuit

A lawsuit filed on May 2, 2018, accuses two Times Square attorneys of defrauding immigrants by pursuing strategies unlikely to improve their status with immigration authorities. Thomas T. Hecht and his son, Leonard H. Hecht, are charged with tricking at least 26 undocumented immigrants by collecting fees for green card applications and then pursuing asylum status without the knowledge or consent of these clients.

A Cautionary Tale

According to Martin Torres Reyes, he first approached Thomas T. Hecht in early 2015 to request help in achieving legal permanent residency in the U.S. Reyes believed he would be embarking on what has become known as a 10-year residency program. Hecht allegedly assured Reyes that he would receive a temporary work permit within six months and a green card allowing him to work and live in the U.S. permanently later on in the process. According to the lawsuit, these benefits never materialized and the Hechts instead pursued asylum status for their clients, a tactic that was unlikely to produce the desired results for these immigrants.

Minimal Chances of Success

According to immigration experts, asylum requests must follow a specific schedule and application process to increase the chances of success. The plaintiffs in the lawsuit against the Hechts, however, indicated that they were never asked questions about persecution or asylum, making it even more unlikely that they would be successful in pursuing this route to citizenship. If denied for asylum, the immigrants would also be at much higher risk of deportation by immigration officials.
