Supreme Court Rules Against Trump Administration on DACA

New York Dreamers

On June 18, 2020, the U.S. Supreme Court handed down a ruling that offers new hope for immigrants in this country under the provisions of the Deferred Action for Childhood Arrivals (DACA) program. In a 5-4 decision, the court reversed a 2017 attempt by the Trump administration to put a stop to the protections of DACA and to render more than 600,000 immigrants vulnerable to deportation from the United States. Dreamers, as DACA recipients are known, often came here in early childhood and may not remember any home outside the United States. The ruling means that New York Dreamers can continue to live, work and study here for the foreseeable future.

Arbitrary and Capricious

In its decision, the Supreme Court stated that the actions of the Trump administration were “arbitrary and capricious” and did not meet the standards required by the Administrative Procedure Act of 1946. Specifically, the court found that the administration failed to provide a reasoned explanation for its actions in rescinding DACA. While the Trump administration is free to make further attempts to reverse DACA, it is unlikely to occur before the upcoming presidential election scheduled for November 2020.
